Terms of Service

1. Acceptance of these terms

By downloading, accessing, purchasing, subscribing to, or using Keyword IQ, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use Keyword IQ.

If you use Keyword IQ on behalf of a company or other organization, you represent that you have authority to bind that organization, and “you” includes that organization.

2. Eligibility and accounts

You must be at least 13 years old to use Keyword IQ. If the law in your location requires a higher minimum age to enter into these Terms, you must satisfy that requirement.

You are responsible for maintaining accurate account information, safeguarding your login credentials, and all activity conducted through your account. Notify us promptly if you believe your account or subscription has been accessed without authorization.

3. Keyword IQ services

Keyword IQ provides tools designed to help founders and builders discover, compare, validate, save, and plan app and business opportunities. Features may include:

• Daily or periodic opportunity feeds.
• Manual market, audience, problem, trend, and keyword analysis.
• Opportunity IQ, Demand IQ, Gap IQ, Competition IQ, Revenue IQ, Monetization IQ, Build IQ, and Founder Fit IQ scores.
• Business-model, pricing, free-tier, premium-feature, and build-plan recommendations.
• Founder DNA personalization.
• Saved opportunities, notes, reports, alerts, and build plans.

We may add, change, suspend, limit, or discontinue features at any time. We do not promise that any particular feature, data source, scan cadence, market, category, or opportunity will remain available indefinitely.

4. AI-generated information and market intelligence

Keyword IQ uses artificial intelligence, public or licensed market information, historical signals, and other analytical methods to generate scores, rankings, summaries, forecasts, pricing guidance, app ideas, and business recommendations.

These outputs are informational and may be incomplete, inaccurate, outdated, duplicated, speculative, or unsuitable for your circumstances. Rankings and scores represent estimates and opinions generated from available inputs, not verified facts or guaranteed outcomes.

You are solely responsible for conducting independent research, verifying facts, evaluating legal and regulatory requirements, reviewing intellectual-property risks, and deciding whether to build, market, purchase, invest in, or otherwise act on an opportunity.

Keyword IQ does not provide legal, tax, accounting, investment, medical, employment, regulatory, or other professional advice.

5. Subscriptions, billing, and renewal

Keyword IQ may offer free features, paid subscriptions, trials, promotional offers, or other purchases. Available plans, prices, billing periods, and included features are shown before purchase and may vary by country or platform.

Apple App Store purchases

• Payment is charged to your Apple ID account when the purchase is confirmed.
• Auto-renewable subscriptions renew automatically unless canceled through your Apple account before the end of the current billing period.
• Your Apple account may be charged for renewal within the period disclosed by Apple before the current subscription ends.
• You can manage or cancel subscriptions in your Apple account subscription settings.
• Refund eligibility and payment disputes for App Store purchases are generally determined by Apple under Apple's policies.

Except where required by law or provided by the applicable platform, fees are non-refundable. Deleting Keyword IQ does not automatically cancel an active subscription.

We may change subscription prices or plan features. Any price change will apply as permitted by the applicable platform and law, with any required notice or consent.

6. Acceptable use

You agree not to:

• Use Keyword IQ for unlawful, deceptive, fraudulent, abusive, or harmful purposes.
• Submit content that infringes intellectual-property, privacy, publicity, contractual, or other rights.
• Attempt to access another user's account, private data, reports, or saved information.
• Interfere with, overload, disrupt, probe, scan, or test the security of Keyword IQ or its providers.
• Reverse engineer, decompile, disassemble, extract source code, bypass technical controls, or create unauthorized derivative works, except where applicable law expressly permits it.
• Use automated systems, bots, scripts, scraping tools, or bulk requests to extract, copy, republish, train on, or commercially exploit Keyword IQ content or data without written permission.
• Resell, sublicense, rent, lease, or provide unauthorized shared access to Keyword IQ.
• Misrepresent AI-generated information as verified research or guaranteed results.
• Use Keyword IQ to violate App Store rules, third-party terms, privacy laws, intellectual-property laws, or other applicable requirements.

We may apply reasonable usage limits, rate limits, security controls, and anti-abuse measures to protect Keyword IQ and its users.

7. Your content and feedback

You retain ownership of information you submit to Keyword IQ, including searches, prompts, Founder DNA information, notes, saved opportunities, and build-plan inputs.

You grant us a limited, worldwide, non-exclusive license to host, process, transmit, reproduce, and display that information only as reasonably necessary to operate, secure, personalize, maintain, and improve Keyword IQ and provide requested features.

You represent that you have the rights and permissions necessary to submit your content. Do not submit confidential information belonging to another person or organization without authorization.

If you voluntarily provide ideas, suggestions, feedback, or feature requests, you grant us permission to use them without restriction or compensation, provided we do not publicly identify you without permission.

8. Keyword IQ intellectual property

Keyword IQ, its software, design, branding, interfaces, scoring systems, reports, text, graphics, databases, workflows, and other content are owned by or licensed to us and are protected by applicable intellectual-property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Keyword IQ for its intended purpose. No ownership rights are transferred to you.

AI-generated opportunity names or concepts may resemble existing products, businesses, trademarks, patents, copyrighted works, or independently developed ideas. Keyword IQ does not grant you intellectual-property rights in third-party material or guarantee that an idea is available for exclusive use.

9. Third-party services and information

Keyword IQ may rely on or link to third-party services, app marketplaces, cloud providers, artificial-intelligence providers, payment platforms, websites, or datasets. Third-party services are governed by their own terms and privacy policies.

We do not control and are not responsible for third-party availability, content, accuracy, security, policies, business practices, products, or services. References to apps, companies, categories, products, prices, rankings, or market activity do not constitute endorsement.

10. Suspension and termination

You may stop using Keyword IQ at any time. Subscription cancellation must be completed through the platform where the subscription was purchased.

We may suspend, restrict, or terminate access if we reasonably believe you violated these Terms, created security or legal risk, failed to pay applicable fees, abused the service, or used Keyword IQ in a way that could harm users, providers, or the platform.

Following termination, provisions that by their nature should survive will remain in effect, including intellectual-property provisions, disclaimers, limitations of liability, indemnification, dispute provisions, and payment obligations incurred before termination.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEYWORD IQ IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT KEYWORD IQ WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, CURRENT, COMPLETE, COMPATIBLE WITH EVERY DEVICE, OR THAT DEFECTS WILL BE CORRECTED.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, SAVINGS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES; OR COSTS ARISING FROM YOUR RELIANCE ON KEYWORD IQ.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO KEYWORD IQ OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

• The amount you paid to Keyword IQ during the 12 months before the event giving rise to the claim; or
• One hundred U.S. dollars (US $100).

These limitations apply regardless of legal theory and even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain liability limitations, so portions of this section may not apply to you.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Keyword IQ, its owner, affiliates, contractors, service providers, and representatives from claims, damages, losses, liabilities, and reasonable expenses arising from your misuse of Keyword IQ, your content, your violation of these Terms, or your infringement of another party's rights.

14. Governing law and disputes

Except where applicable consumer law requires otherwise, these Terms are governed by the laws of the State of Mississippi, United States, without regard to conflict-of-law rules.

Before filing a formal claim, you agree to contact us and attempt in good faith to resolve the dispute informally. Unless applicable law requires another venue, disputes that cannot be resolved informally will be brought in the state or federal courts located in Mississippi, and you consent to their jurisdiction.

Nothing in these Terms limits rights that cannot lawfully be waived under applicable consumer-protection law.

15. Terms applicable to Apple users

When Keyword IQ is downloaded through Apple's App Store, you acknowledge and agree that:

• These Terms are between you and the provider of Keyword IQ, not Apple.
• Apple is not responsible for Keyword IQ, its content, maintenance, support, warranties, product claims, or legal claims relating to your possession or use of Keyword IQ.
• Your license to use Keyword IQ is limited, non-transferable, and subject to Apple's applicable usage rules.
• You must comply with applicable third-party terms when using Keyword IQ.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you.

Unless a separate custom end-user license agreement is presented, Apple's Standard Licensed Application End User License Agreement may also apply to the licensed application.

16. Changes to these terms

We may update these Terms as Keyword IQ evolves, our business changes, or legal and platform requirements change. Updated Terms will display a revised effective date. When changes are material, we may provide additional notice through the app, website, email, or another appropriate channel.

Continued use of Keyword IQ after updated Terms become effective constitutes acceptance to the extent permitted by law.

17. General terms

These Terms, together with the Privacy Policy and any purchase-specific terms shown to you, constitute the agreement between you and us regarding Keyword IQ.

If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a business transfer or reorganization.
